The steps
- Valuation of the property, taking into account the current lease, the rent and the residence.
- Marketing to investors.
- Preliminary agreement, then deed of sale at the notary's office. The notary calculates and collects any capital gains tax (article 6.3).
- End of the activity: cessation declaration on the one-stop business portal, then a final tax return to be filed within 60 days. Celavigestion can close your file for you (additional service set out in your mandate). See also article 4.5.
If you are liable for VAT, let us know before signing the preliminary agreement: depending on whether the buyer takes over the lease, the sale may trigger a VAT repayment (article 3.6).
Documents to gather
- Current commercial lease and any amendments.
- Last three rent statements.
- Latest complete property tax notice.
- Minutes of the last three general meetings and co-ownership documents from the syndic (pre-sale statement, co-ownership regulations).
- Technical surveys, carried out by a certified surveyor.
- Loan amortisation schedule, if an outstanding balance remains.
