For LMNP owners, a capital gain on sale is taxed as for a private individual: income tax plus social charges, with allowances based on how long you have owned the property. It is fully exempt from income tax after 22 years and from social charges after 30 years.
What changed in 2025. For sales completed since 15 February 2025, the depreciation deducted during the letting period is subtracted from the purchase price when calculating the gain. The taxable gain is therefore higher.
Simplified example: a property bought for €200,000, with €50,000 of depreciation deducted, is sold for €220,000. The gross gain is no longer €20,000 but €70,000, before allowances.
Residences not affected by this rule: student residences, serviced residences for seniors or people with disabilities, and nursing homes (EHPAD). Tourist and business residences are affected.
Thinking of selling? Ask us for the total depreciation deducted on your property: the notary and Celavipierre need it to estimate the tax. If you are an LMP (article 3.4), a different regime applies.
