The opening of insolvency proceedings (safeguard, receivership or liquidation) is published in the BODACC, France's official business gazette. A strict deadline starts from that publication.
The key step: filing your claim. Rent unpaid before the court ruling must be declared to the court-appointed creditors' representative (mandataire judiciaire) within 2 months of publication in the BODACC (4 months if you live outside mainland France). After this deadline, you may lose the right to claim it.
What you need to know
- Formal notices or legal action to recover rent due before the ruling are no longer possible: only the declared claim counts.
- Rent due after the ruling must be paid normally by the operator. Please tell us about any delay.
- The administrator decides whether the lease continues. A new operator may propose a different rent: do not sign anything without advice.
What Celavigestion does: we explain how to declare your claim and help you calculate it, based on the information you send us: lease, rent invoices and statements, details of the unpaid amounts. You may also ask a lawyer to file the claim. Do not delay: the 2-month deadline starts from publication in the BODACC.
