Your operator pays your rent directly to you, unless you have asked us to collect it. Each quarter, we tell you the amount of rent expected: compare it with what you have received and report any unpaid rent to us within 30 days.
First: is your operator in insolvency proceedings? If it is under safeguard, receivership or liquidation (sauvegarde, redressement or liquidation judiciaire), the steps are different and the deadlines very short: see article 5.2.
In all other cases
- Ask us in writing to start recovery, attaching the relevant rent invoices issued by Celavigestion. Without this written request, we cannot act.
- First reminder, free of charge, sent to the operator by email.
- Second reminder by registered letter with acknowledgment of receipt, if there is no response. It is charged as set out in your mandate.
- If the operator still does not pay, we suggest the next steps: a formal demand for payment served by a bailiff (commissaire de justice), or referral to a lawyer. These actions are charged in addition, as set out in your mandate. We keep you informed of progress every quarter.
Unpaid rent often affects every owner in the same residence. Joint action with the other owners is usually more effective.
